The distinction in the brief is between, really, the possibility of pregnancy and the impossibility of pregnancy. Unplanned pregnancy, "irresponsible procreation," is simply language.
Whether a pregnancy is planned or unplanned is of no interest to the state. What is of interest to the state is knowing the identity of the baby's father when the baby is born. Where a man and a woman are legally married the presumption is that the husband is the biological father. When the woman is unmarried the state still wants to know who is the biological father, takes her word for it. (DNA paternity testing wasn't in existence until recently to help out in this determination.)
