"Why was Hutch back?"
I missed the first part of the show last night and have no clue as to why Hutch was back. Can someone tell me please.

apparently they wanted to take a poke at Matt's legal eagle style. They brought Hutch back in with a technicality and in doing so allowed Matt to show how much he learned in Law School (not much). They then went even further to rig the luxury challenge to the point where Matt would be eye to eye with one of their Network Excraptutives for a test of legalese.

It was quite fun and funny to watch.

Oh yeah..the answer to your question. They said that since Hutch only implied that he would throw Kip in the pool and never actually made any such attempt to do so, they couldn't boot him for words.

Edited to add the answer to your question..Duh..someone stick a sock in my mouth and shut me up.

That seemed funny to me, because wasn't the rule Hutch broke about not threatening other housemates with harm? Just words, right? Seemed pretty weak, but I guess if you write it up using legalese it sounds better.

Yeah, that was thr rule he broke, and with the legal terms they used, they somehow managed to convince Matt that Hutch hadn't broken the threaten rule.
