Heard this on the radio just now. Some of the people who were given cars on Oprah's season opener may have to sell them. Apparently Pontiac meant the sales tax when they said they would pay the taxes, and since the value of the cars was approx. 28000 each, the federal and state taxes on the gift will be around $6000. Some of the people who received them have indicated they could not afford a new car to begin with, and cannot afford now to pay the taxes, so they may have to sell the new car and buy one with the difference after taxes to drive.

That just seems like a good idea gone terribly wrong.

even after they sell them to pay taxes, they'll still have enough to buy a heck of a lot more car than before the show.

My greed comes through, and when I will the lottery I will be very glad to be in Canada where lottery winnings are not taxed. Only the money you make with your winnings is taxed, so I may not have to pay taxes on anything!

I would agree with the good idea gone bad.
Obviously, she did not think about the consequences of those gifts. I think she will find a way to make it all work out.

I wondered about the tax consequences, trying to assuage my own bitterness at not being in the audience. I would have sold the car, anyway.

My cousin was once given a Porsche for a bonus. When he told his boss he couldn't accept because of the tax implications, Boss added that much more $ to his end of year check. When something like that happens to me, monkeys will be flying out of Oprah's ##### (still bitter).


The order of Banana delivery should be organized by location to save on shipping costs.

I tried to watch today, but she kept drooling on John Travolta wo much and talking about his 50th birthday party that she went to that I could not take it anymore.

But the movie Ladder 49 looks good, and drooling on Travolta is my job (or would be, if there was a job competition for it)

That's the same way it works if you win a car in a sweepstakes or somesuch. If they sell it to cover the taxes they can still afford to buy a very nice Taurus or sumpin.

I know the reality is they still get something out of it, but it just seems sad that they can't keep what they were given. Apparently they were all hand picked as being in real need to qualify for the show.

I think that people tend to forget when they go on these game shows and win $50,000 worth of dinette sets and big screen TVs that they will have to pay a gift tax on the value of their winnings? Worst case in this situation, they sell the new car and buy a very nice used car with the proceeds net the federal taxes. They don't have a lot to complain about in either case. On the other hand, Oprah could pay their taxes for them, but then they would owe another tax on that gift. Of course under the tax laws Oprah could make a one time gift to each...oh..just skip it...

I agree that she was most definately drooling on Travolta. But that movie really looks good. I think it is about time firefighters get a little more attention so people can remember how lucky they are to have these heros around.

It's actually not a gift tax; it's federal and state income tax. These audience members had income by virtue of being on the show. They would receive Form 1099s from the Oprah! show that would show the value of the car as additional income.

FWIW, "gift tax" is charged to estates after death. But, while Pontiac is verrrry, verrrry sick, GM hasn't killed it yet.

Well, Oprah could gross them up enough on the money she gave them for taxes so that they would have enough income to pay all of their taxes without having to sell the car; there's a formula for calculating the amount that her show would have to pay to each.

I can't see why she'd want to, though. Anyone who complains is simply TOO greedy for words.

Not to be insensitive (not me) to the plight of having to sell a new car received from a game show or, as given in this example, I should be so lucky to have that kind of bad luck. Some people may be able to pay the tax out of pocket and others will have to sell their gift, but I don't see this being a "hardship" in any shape or form. Also, thanks for explaining the tax situation stemming from winning prizes. What you said is what I meant.

if they wanted to keep the car, couldn't they just get a personal loan using the car as collateral? The payments on a $6000 loan is gonna be less than a car note.

well, it wouldn't be an unsecured loan. I'd hope if you had a 28K car as collateral, you could get a loan to pay the taxes on it.

We once offered to put up our car as collateral for a loan, but the car was too old and they wouldn't use it. They did, however, give us an unsecured loan without a minute's hesitation. I told my then husband - we gotta change banks these people are idiots to give us this money.

Actually gift tax can be taxed on individuals that give/receive gifts over $10,000 or is it $15,000.... I'd have to look it up. Estate taxes are charged to estates after death.

...the unified credit. which acts to prevent virtually eveeryone from paying gift tax while alive -- but is reduced by the amount of gifts made above the exemption threshold so that you have to pay tax on more of your estate when you die? See Code sections 2010 and 2505.

I was trying to simplify the discussion, since most people's eyes glaze over when the subject turns to tax. With the unified credit, it's simpler to explain gift tax as a subset of estate tax -- which, in fact, it is.

However, you are technically correct: the gift tax applies to gifts (a term which is not defined in the Code, but which does NOT include prizes and awards) made in a calendar year. Although you generally will not pay anyhing until after you die thanks to the unified credit, you have to file any year for which you reduce the unified credit (or, heavens forbid, actually owe money).

Sorry if I confused anyone.

I think he's too busy telling mothers their children are going to turn into serial killers. That takes up a lot of time, you know, especially when you need to use those slow-focus shots on the crying mothers.

For one thing the income tax ought to be on the price Oprah paid not the manufacturers list price. I am sure she got that amount of cars at a very nice discount.

A coworker wrote a letter to Oprah about her sister and brother in law, they were invited to the show and all three got cars. I did not hear about the amount in taxes they were going to pay, so good info. I know they didn't have the color they wanted and they just got vouchers for the cars redemable at their local Pontiac dealership.

I won a car once. It was first prize in a raffle, a 1957 Corvette or $10,000. I took the car, but only had to list the $10K as the value of the prize for tax purposes.

I live 5 miles from the Pontiac G6 assembly plant. Oprah visited here a couple weeks before the giveaway. She didn't even call me! We could have had lunch or gone shoe shopping. The nerve.
