"Woman sues Janet, Justin, MTV, CBS and Viacom"

This is not a joke! A Knoxville woman has sued Janet, Justin, MTV, CBS and Viacom for causing injury during the halftime show!

Here is the story as it appeared in this morning's paper:

State of undress causes distress
Knox woman files suit over halftime show-induced 'injury'

By RANDY KENNER, kenner@knews.com
February 5, 2004

A Knoxville woman filed a proposed class action lawsuit Wednesday against Janet Jackson, Justin Timberlake, MTV, CBS and Viacom, contending she and other viewers were injured by their lewd actions during the Super Bowl halftime show.

Terri Carlin filed her lawsuit "on behalf of all Americans who watched the halftime show" in federal court in Knoxville.

The lawsuit stems from Sunday's now infamous exposure of one of Jackson's breasts when Timberlake ripped off part of her costume during their performance on the CBS network.

Viacom International Inc. owns both CBS and MTV. MTV produced the show.

Carlin, who works at a Knoxville bank, said the exposure and "sexually explicit conduct" by other performers during the show injured viewers.

"As a direct and proximate result of the broadcast of the acts, (Carlin) and millions of others saw the acts and were caused to suffer outrage, anger, embarrassment and serious injury," the lawsuit filed by Knoxville attorney Wayne A. Ritchie II states.

It doesn't specify the type of serious injury.

"All of the defendants knew that the Super Bowl, the pre-eminent sports event in the United States, would be watched by millions of families and children," Ritchie wrote. "Nevertheless, (they) included in the halftime show sexually explicit acts solely designed to garner publicity and, ultimately, to increase profits for themselves."

Carlin referred questions Wednesday night to Ritchie, who has declined to comment.

No one was available for comment at Viacom International Inc., or at Jackson's or Timberlake's record companies Wednesday night.

Jackson has apologized. She said MTV, CBS and the NFL did not know what was going to happen.

The lawsuit claims the broadcast companies and the two singers violated an "implied" contract with viewers not to subject them to allegedly lewd material.

"Families have an expectation that they can trust companies and individuals such as the defendants not to expose families to sexually explicit conduct during broadcasts of prime time events such as the Super Bowl," the lawsuit states.

The lawsuit argues that even if they didn't know what was coming, the broadcasters should have had a "sufficient broadcast delay" to censor the acts.

Because the game is broadcast worldwide, Ritchie also wrote that the actions harmed the "standing and credibility" of Americans throughout the world.

Carlin's lawsuit seeks compensatory and punitive damages worth billions.

She's suing "on behalf of Americans", eh? Wonder if she'd share the profits.

I'd say that even if seeing Janet Jackson's boob caused her to go into cardiac arrest, it wouldn't be worth billions of dollars.

I wonder what Spike Lee would do...

The filing of a crap suit like this always gets big headlines, and people cluck their tongues and talk about how litigious we are. When this inevitably gets tossed out of court, there will be a teeny-tiny story and a very small headline.

And why isn't she suing for the Levitra commercials? Or Cialis? Parents would probably have a more difficult time (I almost said harder) explaining those than explaining Janet and Her Breast.

I think people that file stupid suits like this should have to pay all court costs when they're thrown out. Maybe then they'll stop.

In may countries that is exactly what they do. Loser pays all court costs.

I agree in principle that frivilous suits thrown out because they completely lack merit should have some penalty like this, but I think "loser pays" in general is not a good idea. Many suits are not frivilous, but fail to convince the fact-finder. Such a policy would discourage all but "slam dunk" suits and also favors large businesses and rich people who have the big coffers.

Well, I watched it and was not injured, so.......
if they need an expert testimony on behalf of JandJ I'll volunteer. And I do consider myself to be an expert on boobies and booby injuries
This is stupid. Write a letter to your affliliate if you were that offended but frivolous lawsuits have to stop.

I agree...this woman needs to get a life!

I wish you guys could understand the types of law suits we Knoxvillians have had to endure. Another one that is very close to being as stupid as this...

A female trainer was on the UT football staff when Peyton Manning was here. During his junior year, Peyton was in the workout room. The guys were harassing each other and Peyton mooned a buddy of his in the front of the room (the female trainer was in the front of the room as well). The female sued Peyton for mental anguish and settled out of court! This woman was so distraught over seeing Peyton's ass that she supposedly suffered for months! WTF?

HAHAHA!

We just change the channel during the craptime shows. I think it's dumb that it has to be a big concert event for the football game. They should either do that every football game every sunday all season long thus extending all halftimes to 30 minutes. OR treat the Superbowl the same as every other football game that is played in the 21 weeks leading up to said game. Why should it get different treatment? Why doesn't the 7th inning stretches of the World Series get their own concerts? It's a championship too right? Last i checked, they stand up and sing the "take me out to the ball game" just like every other game all season long.

Hmmm. I think i'm going to sue the NFL and all those other things too, for the emotional anguish this extra B.S. puts me through every year!
