Copying this over from this week's NFL complaining thread:'It's starting to get uglier. For starters, some papers are reporting that Plaxico had been drinking alcohol before the gun went off. To ramp it up, add in the fact that Antonio Pierce was with him -- and was apparently given the gun after it went off, with instructions to dispose of it. Throw in the fact that the police were denied entry to the Burress household... If you have a license to carry concealed and wind up shooting yourself in the thigh with your own gun, you will get a very stern lecture. If the gun wasn't registered, if you don't have the license... then the wound still has to be reported to the police. Maybe Plaxico missed those fifteen thousand episodes. The gun may have been completely illegal. I think we're looking at a 'what permit?' situation. And Plaxico may not be a Giant for much longer. So -- Glow, want him back? We'll pay shipping. ETA: Yep. We are now firmly at 'What permit?': looks like Plaxico didn't have the critical license to carry the gun concealed in New York, and that means he's likely to face criminal charges. No clear word yet on whether the gun itself was legally owned. Pierce may have a court date in view for the disposal (or attempt at same) and he's likely looking at a big fine, but he probably won't face jail time. Depending on the report you here, there was either one or two other Giants at the club when this happened, not yet identified -- but they weren't involved in the weapons disposal. And a re-ETA: Charges will be brought against Plaxico. Maximum jail time: five years. Antonio's lawyers are currently meeting with prosecutors, trying to find a deal that will keep him off the trial docket.' Want a topper? The police can't seem to find him...

He'd better have company, because the jail time situation is worse than it originally looked. Remember that five-year maximum? There's another end to that. Mayor Michael 'Tax The Air? I'm Saving That For My Fourth Term' Bloomberg instituted a mandatory 42-month minimum sentence for exactly this offense, applicable to any NYC-based violation. Antonio Pierce is fully cooperating with police and helping them locate the gun, which is not yet in custody. There was an interesting discussion on the FOX pregame show about this, headed by Michael Strahan and his very expert opinion on the Giants' gun policy. Yes, they have one. Because the players go into the city regularly and have preseason practice in the state, the team collects all weapons from the players at the start of training camp, carefully explains the city's policy, tells them it doesn't matter if they're licensed in another state if they don't have the NYC paperwork, and you can have the gun back when camp breaks. (Presumably you're supposed to use the time to get the necessary documents.) Guess that's another meeting Burress skipped. Or ignored. Strahan has been talking to people in the franchise and his opinion is that the Giants feel Plaxico is making them look stupid. He believes they don't want to give him an outright release -- to him, the team treats people like more of a family than most franchises do -- and they'd rather help him put his life together. But if they have to, they will. And they've been pushed up against the wall. They've been trying to offer help and he keeps turning away from it: how much can they do? Fines don't work. Suspensions don't work. Heart-to-heart talks... don't even ask. Because of the incident's nature, the Giants are free to go after Plaxico's signing bonus (as in 'Take it back. Take it all back). Maybe that could wake him up. ...probably not.

Or lower, in the foot. Or, heck, why not level with the gut.What a legal mess for him as the team moves on. Dumb, dumb, dumb, even if he did once have a valid FL license to carry. Ok, so maybe some of the Giants players are concerned about their security - can't blame them, either. Seems to me the team should actively help the players who indicate their choice to own or carry firearms for self-protection. Burress (and the Giants as an organization) got sloppy and he is almost certainly not alone among Giants (and other NFL) players in not being properly licensed. Dozens wouldn't surprise me. Burress got caught only because it accidentally went off. Jail for this? I understand the reasoning behind the law (maybe gang warfare, for starters), and there's no excuse for Burress' laziness and stupidity in not recognizing the seriousness of his legal transgression. I don't think the law was drafted with the intent of prosecuting major public figures who might carry a concealed weapon without license as it was to attempt to reduce the incentive of some criminals to carry an armed weapon without license. But the law is the law, and it's going to bite.

And Plax merely shot himself and gets 20 months while Vick got 23 months for a worse crime (in my mind) of running an extensive dog-fighting ring with drugs/gambling involved and being directly or indirectly involved in abusing, torturing and murdering dogs.

But as soon as you get out? You're reinstated, and can sign with a team...... This is based on that Goodell was going to suspend him for this year anyways...... so he figures that the two years or so of jail time will be more than enough.........

But think of it, how stupid can one person be? A guy making millions, starting in the NFL (a super bowl hero, no less), a guy that has achieved Sports Nirvanna (of a sort). And this guy - carries a pistol (apparently without permit?). What, he has no entourage to carry his drugs and guns for him? - Into a night club (which is surely illegal). - The gun is tucked into his waistband (or pants pocket?). There have probably been more manhoods shot off like this than there have been Lorena Bobbit copycats. - And shoots himself in the leg (luckily missing aforementioned manhood). Listen, you don't just accidentally shoot yourself in the leg. The pistol has to be loaded, a round chambered (I'm guessing it was a glam weapon, an expensive automatic), the safety switched off, the hammer might have to be cocked, then the trigger has to be pulled. I'm not an expert, but I don't know of any pistol that just goes off. He was doing something with it. Either playing a tragic game of pocket pool (code), or showing off. This guy needs guidance. Wherever he is. Haven't read the posts in this thread yet (and I will, I will), but at the risk of taking a tangent, I have to say that 2 years prison seems a bit extreme for this. If it's federal he will have to do all of it. His main crime was making Bloomberg mad, it would appear. And being almost certifiably stupid.
