Here's a situation that has me wondering which is the better option, so naturally, I'm going to OT for the sagest opinions known to mankind.Here's the situation: A tenant has a room rental with the lease expiring on August 31st. Notice has already been given to move out on that day, so the rent has already been paid for the month of August (the 'last' portion of first+last). Everything seems to be in perfect order and there's not a scratch of damage anywhere so it's just a formality to get the security deposit back as well. The landlord is apparently a very easy-going and fair guy to work with and not a hint of trouble there. Now, it seems there's someone else who wants to move in on July 27th and has an international visa to stay until December 1st. The normal lease period for this place is from September 1 to December 31 (it's across the street from the college). Fine, not a problem since the room has already been vacated. The landlord is offering the tenant to give half of the $400 final month rent back along with the full security deposit in exchange for agreeing to let go of the room on July 26th, with the other $200 to be paid on December 1 if they find someone to take over the room on that day after the international student leaves, with the reasoning that it's hard to find someone to move in on December 1 instead of January 1 as most students do. So... I found this to be odd. It's the landlord's problem if they can't find someone else to take over on December 1, but the flip side of the argument is that if the tenant says, "no, give me the full final month back" then the landlord could just say okay forget it, we'll just leave the room empty until September 1 when there would be many students looking to rent for the full fall semester, meaning the tenant would still pay the full $400 for August. So, is it better for the tenant to hold ground and say pay me the full August rent and it's the landlord's problem to find someone for December 1, risk losing this international student and having to pay for August ... or take the guarantee of the $200 now with the hope of getting another $200 in December? Not sure about the legality of this kind of thing as I'm not having much luck finding this kind of situation as described on Google, but what do you guys think? Thumbs up or thumbs down to the landlord's suggestion?

You're peace of mind will be worth it, plus there's that revenge factor about the gun. ps: don't get caught!More seriously, It depends on how much you need the cash flow. Bird-in-the-Hand and all that VS fiddling with the dopey thing. Sure, there could be a moral dilemma by wasting the space for a while, but you may be able to use it for some forbidden nooky. foonermint: peace and love, brothers!

I don't think you have to worry about legality, contracts can always be amended if both parties agree. With the $200 split though, either rented or not he will have only 1/2 month rent for that unit for 1 month.
